Commission

There are three members on the County Commission. One must reside in each of the three magisterial districts (Eastern, Central, and Western); however, they are elected by all voters county-wide. Commissioners hold their office for the term of six years; and one Commissioner is elected every two years. They choose one of their members each year to serve as president, who presides over the meetings.

Duties and Responsibilities of a County Commission in West Virginia

A County Commission is the governing body of a county in West Virginia, responsible for overseeing county operations, finances, and public services. Established under West Virginia Code §7-1-1 et seq., County Commissions exercise legislative, executive, and administrative authority to manage county affairs efficiently.

Key Duties and Responsibilities:

  1. General Governance (§7-1-3) ~ Serve as the executive authority for the county, enacting policies and regulations that affect county residents.
    Exercise powers not specifically granted to other elected officials, ensuring the smooth operation of county government.
  2. Budgeting and Financial Oversight (§7-5-1 et seq.) ~  Prepare, approve, and manage the county’s annual budget. Oversee county expenditures and financial planning, ensuring responsible use of taxpayer funds. Levy and collect taxes as authorized by state law Conduct financial audits and ensure fiscal transparency.
  3. Infrastructure and Public Works (§7-3-2, §7-14-1 et seq.) ~  Oversee the maintenance and construction of county roads, bridges, and public buildings. Manage public utilities and services such as water, sewer, and emergency communication systems. Supervise the operation of county parks and recreational facilities.
  4. Law Enforcement and Public Safety (§7-14-1 et seq.) ~  Work with the Sheriff’s Office to ensure law enforcement and public safety. Provide funding for emergency services, fire protection, and disaster response. Establish and oversee regional jails and detention centers.
  5. Land Use and Planning (§8A-2-1 et seq.) ~  Regulate zoning and land development through the county Planning Commission. Approve or deny building permits, subdivision plans, and land-use applications. Promote responsible growth while preserving natural resources.
  6. Elections and Voter Registration (§3-1-1 et seq.) ~  Supervise and administer local elections in coordination with the County Clerk. Oversee voter registration and ensure election integrity. Canvass election results and certify winners.
  7. Appointment of County Officials and Boards (§7-1-3m) ~ Appoint members to various boards, including the Planning Commission, Health Board, and Economic Development Authority. Fill vacancies in county offices when necessary.
  8. Public Health and Welfare (§16-2-2) ~ Oversee the funding and operation of county health departments. Implement public health initiatives and emergency response plans. Support community programs for social services and mental health.

  • Conduct open meetings to ensure government transparency.
  • Publish meeting dates, minutes, and financial records for public review.
  • Allow citizen input on county decisions and policies.
